Orihuela to pay €43,500 to girl who fell on the gate of a park

THE City of Orihuela has been ordered to pay compensation of 43,500€ to the young girl who broke her femur after falling on the iron gate of Severo Ochoa park in November 2012.

The events occurred as the then ten-year-old girl was playing friends, swinging on the gate to the park.

Suddenly, the girl fell, destroying her femur, which has required surgery to regain mobility.

The girl’s parents lodged a complaint against the council, claiming the accident would not have happened had the gate been properly maintained – it only had one screw holding it together at the top and the frame was completely rusted.

The young girl was faced with a slow recovery and long rehabilitation period as her femur was crushed.

The judge found the council to be negligent and ruled in favour of the young girl. The compensation will be paid by the Civil Liability Insurance, whilst a bond of 3,000€ will need to be met by the council.
