Q: My partner and I have been together for decades, but we are not married. What are our rights with regards to inheritance and inheritance tax?

A: If a couple are not married they have no claim to inherit any share of their partner’s assets. In addition, inheritance tax will be higher between couples who are not married than their married counterparts.

In the first instance the most important aspect is to draw up and sign a will, carefully dividing your assets in the manner that you wish to.

Please remember to state in your will the European legislation that allows you more or even free disposal of you assets. Otherwise the Spanish law will apply.
